"Don't Treat Kizza Besigye Special During His Trail, Try Him Just Like Other Criminals" Declares Chief Justice Owiny-Dollo

Chief Justice Alfonse Owiny-Dollo has called on members of the judiciary to ensure that Dr. Kizza Besigye is tried fairly, without any special treatment. Speaking at the 8th Annual Benedicto Kiwanuka Memorial Lecture at the High Court in Kampala, he stressed the importance of impartiality in the justice system.

He warned that showing favoritism to any individual, including high-profile figures like Besigye, could set a dangerous precedent both in Uganda and internationally. “Dr. Kizza Besigye should be tried without fear or favour,” Chief Justice Owiny-Dollo said, highlighting the principle that all citizens are equal before the law.

The Chief Justice emphasized that judges must not be influenced by public opinion, political pressure, or personal biases when handling high-profile cases. He said that fairness and consistency in the judiciary are key to maintaining public trust in the legal system.

Besigye, a prominent political figure, is currently facing serious charges, including illegal possession of firearms, ammunition, and treachery. His aide, Obeid Lutale, is also facing similar charges. These cases have drawn national and international attention, making impartiality even more crucial.

“Try Dr. Kizza Besigye without getting scared or afraid,” the Chief Justice added, urging judges to carry out their duties courageously and without intimidation. He highlighted that justice must be based on facts and the law, not on the profile of the accused.

Owiny-Dollo also called on the judiciary to treat Besigye just like any other criminal facing trial. “Don’t treat Kizza Besigye special during his trial,” he declared, emphasizing that equality before the law is a cornerstone of democracy.

The Chief Justice noted that failing to uphold this principle could damage Uganda’s reputation as a country that respects human rights and the rule of law. He stressed that the judiciary plays a critical role in safeguarding democracy by ensuring fair trials.

During his speech, he also paid tribute to Benedicto Kiwanuka, Uganda’s first Prime Minister and a symbol of justice and integrity. He reminded judges that Kiwanuka fought for an independent judiciary and that current judicial officers have a responsibility to uphold those values.

Legal experts have welcomed the Chief Justice’s remarks, saying they reinforce the need for impartiality in high-profile cases. They argue that public confidence in the legal system depends on seeing justice done equally, regardless of an individual’s status or political influence.

As the trial of Dr. Kizza Besigye and Obeid Lutale continues, the judiciary faces the challenge of balancing high public attention with the principles of fairness and justice. Chief Justice Owiny-Dollo’s guidance serves as a clear reminder that the law must treat everyone equally, without fear, favour, or prejudice.
