Can You Use ™ Without Registration in India?

While you can use the ™ symbol without registration in India, the ® symbol is strictly reserved for marks that have cleared the full registration process. It's illegal to use the ® symbol if you only have a pending application or no application at all. 

Section 107 of the Trade Marks Act 1999 makes the unauthorized use of the ® symbol a punishable offense. This can result in fines or imprisonment. But there are no such penalties for using the ™ symbol, provided you aren't infringing on an existing brand's rights. 

Establishing Evidence Through the Use of the ™ Symbol 

Using the ™ symbol offers practical advantages in legal disputes. If a competitor copies your brand, your consistent use of the symbol serves as evidence in a "passing off" lawsuit. This is a common law remedy used to protect the reputation and goodwill of unregistered brands. 

It demonstrates to the court that you've actively claimed the mark and that the public associates it with your business. But remember, "passing off" cases are harder to prove than infringement cases involving registered marks. You must provide extensive proof of your brand's reputation and the likelihood of consumer confusion. 

Why Formal Registration Remains the Necessary Final Step 

We advise you to view the ™ symbol as a temporary measure rather than a permanent solution. An unregistered mark doesn't give you the statutory right to sue for infringement. To gain nationwide exclusivity and the strongest possible legal protection, you must obtain a Registration Certificate. 

Once the Trademark Registry grants your application, you should immediately switch from the ™ symbol to the ® symbol. This change signifies that your brand is fully protected under Indian law, granting you the power to block others from using similar marks in your industry.
