Prosecutor Fails to Block Doctor’s Testimony in Kayanja Case as Medical Council Clears Qualifications

The prosecution has failed to block a government doctor from testifying in the case involving Pastor Robert Kayanja after the Uganda Medical and Dental Practitioners Council reportedly confirmed the doctor’s professional qualifications.

Mwanga II Grade One Magistrate’s Court on Monday ruled that Dr Bwambale Phenehas is eligible to give evidence in the case, with his testimony scheduled for September 7, 2026.

The development follows an earlier objection by State Prosecutor Jonathan Muwaganya, who had questioned Dr Bwambale’s qualifications and his competence to testify on matters relevant to the case.

When the matter returned to court, Muwaganya told court that he had received clarification and instructions regarding the doctor’s qualifications, paving the way for him to testify.

The court had sought confirmation from the relevant medical authorities regarding Dr Bwambale’s professional credentials. 

The authorities subsequently confirmed that he possesses the required qualifications, including a Master’s degree in Pathology, according to the information presented to court.

The defence maintained that Dr Bwambale should be allowed to give evidence, arguing that his professional credentials met the requirements for him to appear before court.

Magistrate Adams Byarugaba subsequently accepted the clarification on the doctor’s qualifications and ruled that there was no basis to prevent him from testifying.

The prosecution also urged the defence lawyers to avoid further delays and present all the witnesses they intend to call so that the trial can proceed.

The case involves Pastor Robert Kayanja and allegations surrounding claims made against him by a group of young men. The accused persons have denied the allegations and are facing charges arising from the disputed claims.

Dr Bwambale’s testimony is expected to be closely followed when he appears before court on September 7, 2026.
